Heartgild Terms of Use

These terms are an agreement between you and Diversity Holdings Group LLC ("we") for the Heartgild app and website. By using Heartgild you agree to them. If you do not agree, please do not use it.

What Heartgild does

Heartgild uses AI to make new images in a theme you choose from a photo of your pet. Results are generated, can look different from the real pet, and may contain mistakes. You are responsible for checking them before you use or share them.

Plans and purchases

• Free: 1 free portrait per install, in any theme.
• Themed packs (one-time, $9.99): choose any 4 themed packs of 10 portraits (40 in all), for up to 4 pets. Credits never expire and can be bought again.
• Heartgild Pro (one-time, $99.99): every theme unlocked, 600 portraits, unlimited pets, credits never expire.
• Unlimited (subscription, $6.99 per week): every theme, subject to fair use below. It renews automatically every week until you cancel. Cancel any time. On Android: Google Play (Play Store, Payments and subscriptions, Subscriptions). On iPhone: Settings > your Apple ID (Apple Account) > Subscriptions > Heartgild. Cancelling stops the next renewal; you keep access until the end of the paid week.

Purchases are made inside the app through Google Play on Android or the App Store on iPhone. Prices are shown in the app in your local currency and are charged by that store. Portraits are counted as images: one portrait is one image. A portrait made from extra photos for a closer match uses 2 credits.

Credits are stored on your device

Credits from packs and Heartgild Pro live on your device. If you uninstall the app, reset it, delete your data or change phones, unused credits are lost and we cannot restore them. Unlimited can be restored with Restore purchases (through Google Play or the App Store).

Refunds

Purchases are billed by Google Play on Android or the App Store on iPhone, and that store handles refunds under its own policies (on iPhone, you can request one at reportaproblem.apple.com). Contact the store first for a refund of a purchase or subscription. If a portrait fails to generate, it is not counted against your credits or limits. If you were charged and something went wrong, email flexweightfitness@gmail.com and we will help.

Fair use of Unlimited

Unlimited is for personal, normal use. Generation slows down after 100 portraits in a day or 160 in a week, and pauses at 200 in a day or 320 in a week, until the window resets. We may limit or block use that looks like abuse.

Your photos and your portraits

You keep ownership of the photos you upload. You confirm that you have the right to use them and that they are photos of pets. You may use the portraits you make for personal use and for your business, such as a grooming shop or shelter. Because portraits are made by AI, we cannot promise they can be copyrighted or that they are free of resemblance to other images. We do not use your photos to train AI models; see our privacy policy.

Acceptable use

Heartgild is for pet photos only. Do not upload photos of people, nudity or sexual content, violence or gore, or anything you do not have the right to use, and do not use Heartgild to break the law, deceive people or harm animals. Do not try to get around limits or purchases, copy or resell the service, or attack our servers. See the content policy.

Disclaimer and liability

Heartgild is provided "as is" without warranties of any kind. To the extent the law allows, we are not liable for indirect or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing here limits rights you have under the law where you live.

Ending use and changes

You can stop using Heartgild at any time. We may suspend access for breaking these terms. We may update these terms and will post the new date here. These terms are governed by the laws of the State of Wyoming, USA, except where your local law requires otherwise.
